Is it calculated on basic salary or gross?
On the actual final wage, which legally includes regular fixed allowances such as housing and transport. Calculating on basic salary alone is a common error that understates your entitlement.
When is the benefit forfeited entirely?
In lawful dismissal cases under Article 80 (assault, forgery, disclosing trade secrets, etc.) and in resignation before completing two years. Otherwise it is a right that cannot be waived by agreement.
Do leaves and absences reduce the service period?
Paid statutory leave counts within the service period; extended unpaid leave may be excluded depending on the case. Service runs from the start date to the last actual working day.
